Driver Requirements

All drivers must:

  • Be at least 21 years old.
  • Hold a valid driving licence accepted in Greece.
  • Present valid identification upon request.
  • Comply with all Greek traffic regulations.
  • Hold a valid full driving licence for the vehicle category being rented.
  • Have held their driving licence for at least two (2) years before the rental start date.
  • Present the original driving licence at vehicle collection.
  • Present an International Driving Permit (IDP) where required by Greek law.

The Company reserves the right to refuse delivery of the vehicle if these requirements are not met.

Driver Eligibility

Drivers must meet the minimum age requirements published on our website for the selected vehicle category.

Only drivers approved by the Company and listed in the Rental Agreement are permitted to operate the vehicle.

Allowing any unauthorized person to drive the vehicle constitutes a breach of this Agreement.

Vehicle Inspection

The renter confirms that the vehicle has been inspected before departure and accepted in good mechanical and cosmetic condition unless otherwise noted in writing.

Any existing damage will be recorded before the rental begins.

Driver Instruction

Before departure, the renter receives instructions regarding the safe operation of the vehicle.

By operating the vehicle after the instruction has been completed, the renter confirms that:

  • the controls have been understood;
  • the vehicle is suitable for use;
  • no further explanation is required.

GPS Tracking

All vehicles may be equipped with GPS tracking devices.

GPS information may be used to:

  • locate the vehicle;
  • assist in case of emergency;
  • investigate accidents;
  • verify compliance with these Terms and Conditions;
  • investigate unauthorized or prohibited vehicle use.

Off-Road Driving

The Company does not prohibit driving on unpaved roads, mountain roads or dirt tracks where access is legally permitted.

However, the renter acknowledges that:

  • driving on such roads is entirely at their own risk;
  • insurance does not cover damage resulting from off-road or rough terrain driving unless expressly stated otherwise;
  • the renter remains fully responsible for any damage caused during such use.

Driving on private land without permission, protected areas where vehicle access is prohibited, beaches, sand dunes, riverbeds or any area where driving is prohibited by law is strictly forbidden.

Improper Use

The renter shall be fully responsible for damage resulting from improper or negligent use of the vehicle, including but not limited to:

  • aggressive driving;
  • drifting;
  • excessive wheel spin;
  • jumping;
  • driving through seawater;
  • driving through deep water;
  • incorrect use of four-wheel drive systems;
  • incorrect use of differential locks;
  • simultaneous use of accelerator and brake pedals;
  • overloading the vehicle;
  • using incorrect fuel;
  • continuing to drive after warning lights or obvious mechanical problems appear.

This list is illustrative and not exhaustive.

Mechanical Damage

Damage resulting from misuse or negligent operation is not considered normal wear and remains the renter’s responsibility.

This includes, but is not limited to:

  • suspension;
  • steering components;
  • CV joints;
  • drive shafts;
  • transmission;
  • differential;
  • CVT transmission and drive belt;
  • clutch components where applicable;
  • wheels;
  • tyres;
  • underbody;
  • body panels;
  • lights;
  • windscreen.

Accidents & Damage

In the event of an accident, theft, attempted theft or any damage, the renter must immediately contact the Company.

The renter must not:

  • continue driving if doing so may increase the damage;
  • authorize repairs by third parties;
  • abandon the vehicle without informing the Company.

Deposit

The security deposit may be retained until the vehicle has been fully inspected.

Where damage is identified, the Company reserves the right to deduct the repair costs and any associated losses in accordance with applicable law and the Rental Agreement.

Vehicle Cleanliness

The vehicle must be returned in reasonably clean condition.

If excessive dirt or mud prevents a proper inspection for damage, the Company may delay the release of the security deposit until the vehicle has been cleaned and inspected.

Lost Items

The renter is responsible for the replacement cost of lost or damaged:

  • keys;
  • remote controls;
  • vehicle documents;
  • registration plates;
  • accessories supplied with the vehicle.

Traffic Violations

The renter is fully responsible for all traffic fines, parking violations, towing charges and administrative penalties arising during the rental period.

Territory

Vehicles may only be operated on the island of Crete unless prior written authorization has been provided by the Company.

Transporting the vehicle by ferry or outside Crete without written permission is prohibited.

Acceptance of Terms

By making a reservation through our website or signing the Rental Agreement, the renter confirms that they have read, understood and accepted these Terms and Conditions in full.


Security Deposit

Drivers under 25 years old are required to provide a refundable security deposit:

  • ATV / Quad: €500
  • Buggy / UTV / SxS: €1,000

The Company reserves the right to request a security deposit from any customer regardless of age.

Deposits may be used to cover damage, missing equipment, towing, cleaning, traffic fines, administrative costs and loss of use.


Vehicle Responsibility

The renter is fully responsible for the vehicle during the rental period.

The renter agrees to compensate the Company for any loss, damage, theft, misuse, negligence or violation of these Terms and Conditions.

Vehicle Operation and Customer Responsibility

By accepting the vehicle, the Customer confirms that they are familiar with the operation of this type of vehicle or have received all explanations they consider necessary before commencing the rental.

If the Customer is uncertain about the operation of any function, including but not limited to the 2WD/4WD system, differential lock, reverse gear, parking brake, dashboard controls, or any other vehicle feature, the Customer must request clarification from the Company before or during the rental.

If the Customer does not receive a response to a text message within a reasonable time, the Customer must contact the Company by telephone before continuing to use the vehicle.

The Customer agrees not to continue operating the vehicle while uncertain about its controls or functions.

Failure to request assistance or continuing to use the vehicle without contacting the Company shall constitute acceptance that the Customer understood the operation of the vehicle and that the vehicle was suitable for its intended use.

Claims for refunds, compensation, or price reductions based solely on the Customer’s unfamiliarity with the vehicle’s controls or features, where the Company was not given a reasonable opportunity to provide assistance, will not be accepted.


Damage and Loss of Use

The renter is responsible for all repair costs resulting from:

  • Accidents
  • Rollovers
  • Negligent operation
  • Off-road misuse
  • Mechanical abuse
  • Damage caused by unauthorized drivers

If the vehicle becomes unavailable for rental due to damage, the renter may also be charged for loss of use based on the standard daily rental rate.


Payment Authorization

By completing a booking, the customer authorises ALLIGATOR QUAD, ATV, BUGGY & UTV RENTALS CRETE to recover any unpaid charges arising from damage, loss, traffic fines, administrative costs, towing expenses, legal expenses and breach of these Terms and Conditions.


Cancellation Policy

Rental Bookings:

  • Free cancellation up to 7 days before rental start.
  • Deposits may be non-refundable for late cancellations.
  • No refunds for no-shows.

Tour Bookings:

  • Free cancellation up to 15 days before departure.
  • Deposits are non-refundable within 15 days before departure.
  • If cancelled by the Company, all payments received will be refunded.

Limitation of Liability

ATV, Quad, Buggy and UTV operation involves inherent risks.

Customers participate at their own risk and are responsible for operating the vehicle safely and in accordance with all applicable laws.

Nothing in these Terms excludes liability where exclusion is prohibited by Greek or European law.


Privacy

Customer information is processed in accordance with GDPR and applicable European data protection laws.


Governing Law

These Terms and Conditions are governed by the laws of Greece.

Any dispute arising from the use of this website or rental services shall be subject to the exclusive jurisdiction of the courts of Heraklion, Crete, Greece.
